Pre-Nuptial and Post-Nuptial Agreements

There are a lot of myths and misconceptions regarding nuptial agreements (a formal written agreement), but it is important to consider the practicalities and potential pitfalls before considering whether a nuptial agreement is the right option for you.

Nuptial agreements were initially served for the rich and famous; however, they are becoming quite popular with couples, especially in circumstances where one family may be significantly wealthier than the other or where parties are entering subsequent marriages.

Following a supreme court decision in the case of Radmacher v Granatino, nuptial agreements are a sensible consideration to determine how assets are shared should a couple separate, divorce, or dissolve their civil partnership. Whether you are planning your wedding or already married, and want to protect your wealth or secure your position in the future, we can help prepare an agreement that will reduce financial and emotional stress in the event your relationship breaks down. Also, if you have children, it will ensure they are provided for. Before a nuptial agreement can be prepared, the process will require disclosure of each party’s finances and will set out the parties’ assets, current ownership, and what the parties would like to happen if they separate. It also allows the parties to have an element of control over the future.

Whilst the agreements are not binding as such, they will be upheld if they are considered to be fair and properly drawn up following full financial disclosure in all of the circumstances of the case.
