International and Expat Divorce
International and expat divorce can be complex so couples need to find out their options as to which country they should issue divorce proceedings as they may be able to get divorced in more than one jurisdiction, however you cannot get divorced anywhere.
Depending on where divorce proceedings are issued, it may have a significant impact on the division of the financial settlement. The process in the UK court is relatively straightforward compared to many other countries, and because the UK court base their settlement decisions on equality and fairness, this has resulted in many high-profile international divorces taking place in the UK.
UK court jurisdiction for divorce
A divorce in the UK court can take place if it has jurisdiction to deal with the divorce, including as follows:
- You and your spouse are habitually resident in England and Wales;
- Either you or your spouse continue to reside in England and Wales;
- The applicant who is lodging the divorce is domiciled and habitually resident in England and Wales and has resided in the UK for at least six months before issuing proceedings;
- You and your spouse are domiciled in England and Wales; or
- You or your spouse is domiciled in England and Wales.
