Impact of Domestic Abuse, including false allegations regarding Domestic Abuse
Domestic abuse is defined in law, as any behaviour which is abusive between two people who are personally connected to each other and are over 16 years of age.
Behaviour can be abusive if it consist of the following:
- Physical abuse
- Psychological, verbal and emotional abuse
- Sexual abuse
- Violent or threating behaviour
- Harassment or stalking
- Controlling or coercive control
- Financial abuse
Acknowledging that a partner, spouse or family member is abusing a victim is one of the hardest steps they can take and the impact of the behaviour can cause the victim to feel trapped in their own home and it is well recognised that victims often remain in a relationship for several years before they actually end it.
No two cases are the same and where you are a victim of domestic abuse, your safety and wellbeing is our priority. We handle domestic abuse cases with sensitivity and confidentially. We can assist with obtaining protective orders, namely
- non-molestation order: which protects you and/or the children from being threatened, harassed, harmed by the perpetrator or through third parties;
- occupation order: set out who can live and occupy the family home and can also prevent the perpetrator from accessing the family home.
It is possible to apply to the court without giving notice to the perpetrator so that a non-molestation order can be made by the court to immediately offer protection to you and/or the children if needed.
We also represent people who are the respondents to such application. We can help negotiate terms of an order to ensure certain arrangements can continue, i.e. contact with the children and/or discharge the non-molestation order and occupation order if at all possible.
