Cohabitation is where an unmarried couple live together in a long term relationship but do not marry.

There is a misconception as to the myth known as “common law marriage” and that there are legal rights for cohabiting couples to claim financial relief after separating and unmarried couples are often very misguided and misinformed as to their legal position upon separation. It is important to understand that if a relationship comes to an end, you do not have the same rights as couples who are married or couples in civil partnerships.

Also depending on how any property is legally and beneficially owned during the relationship, there may be the potential for a claim in relation to jointly occupied property under the Trust of Land and Appointment of Trustees Act 1996 [TOLATA]. However, such applications are far from straightforward and can be very expensive, which is why it may be beneficial to prepare a cohabitation agreement to protect matters relating to cohabiting couple in the event of a separation and/or breakdown.
