Abandoned spouses
Spousal Abandonment is the deliberate stranding of a spouse abroad and without the necessary travel documents, including passport and without the intension of returning to the jurisdiction of England and Wales.
Some cases may also involve the abandoned spouse being either abandoned with or separated from their children and in such situations, wardship orders are needed to protect the children and declaring that the English courts have jurisdiction in respect of decisions concerning the children.
By making the children wards of court, no orders concerning the children can be made unless ordered by the court, this includes the children being prevented from being taken away from the jurisdiction of England and Wales without the courts consent and permission,
In such cases, it is necessary to seek urgent legal advice in order to regain entry in the jurisdiction.
